Terms of use
Shift Planner · Android · com.gibses.gestioneturni
1. Who offers the app
The app is offered by GiBSeS OÜ, registry code 17231761, VAT number EE103040763, Juhkentali 8, 10132 Tallinn, Estonia ("we"). These terms apply to the Android app. By installing or using it you accept them. Downloads and purchases through Google Play are also governed by Google Play's terms; Google is not a party to these terms.
2. Licence
We grant you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, to plan shifts and record hours for yourself or for your organisation. Where a subscription applies, full use of the app may require an active free trial or subscription (section 3).
You may not sell, rent or redistribute the app, remove copyright or licence notices, or decompile or modify it, except where the law allows this regardless of these terms.
The open-source components included in the app are covered by their own licences, listed in the legal notice. For those components, their licences take precedence over these terms.
3. Subscription, free trial and payment
- Shift Planner is distributed on Google Play as a subscription. The periods and prices available, taxes included, are shown in Google Play before you confirm the purchase.
- New subscribers get a 30-day free trial. Google Play decides who is eligible; it normally offers a trial only once per account. Nothing is charged during the trial.
- If you do not cancel before the trial ends, the paid subscription starts automatically when the trial ends, and Google Play charges the price of the period you chose.
- The subscription renews automatically at the end of each period, at the price then in force, until you cancel it.
- You can cancel at any time in the Google Play app, under Payments & subscriptions → Subscriptions. Uninstalling the app does not cancel the subscription. After you cancel, the subscription stays active until the end of the trial or of the period already paid, and nothing more is charged.
- Payments are processed by Google under the Google Play terms. Refunds are handled by Google under the Google Play refund policies; you can also write to us at legal@gibses.com. This does not limit your statutory rights.
- If we change the price, Google Play informs you in advance and, where its rules require it, asks for your consent. A new price never applies to a period already paid.
- When the trial or the subscription ends, the data you entered stay on the phone and are not deleted. The app may limit its functions until a subscription is active again.
4. Right of withdrawal (consumers in the EU and EEA)
If you are a consumer in the European Union or the European Economic Area, you may withdraw from the contract within 14 days of its conclusion, without giving any reason.
- With the free trial: the contract is concluded when you start the trial. During the trial you pay nothing and can withdraw simply by cancelling the subscription in Google Play. The 14 days end before the first charge.
- Without the free trial (for example, if you have already used it): the app is supplied as soon as you buy. If, at purchase, you expressly agree that supply begins immediately and acknowledge that you thereby lose the right of withdrawal, the right ends when supply begins, as the law allows. Otherwise you can withdraw within 14 days of the purchase by requesting a refund in Google Play or by writing to legal@gibses.com.
- Automatic renewals do not start a new withdrawal period. You can still cancel at any time to stop the next renewal.
- If you buy the subscription for your business, the right of withdrawal for consumers does not apply.
5. What remains your responsibility
The app helps you plan; it does not replace the checks the law requires. In particular, you remain responsible for:
- complying with labour law, collective agreements, rest periods and maximum working hours;
- checking hours and absences before using them for payroll;
- the holiday calendar: the app calculates national public holidays (for Italy with its own rules, for other countries from a public dataset). Regional and local holidays are not included and the data may contain errors: check them and correct the calendar in the app where needed;
- employees' personal data: as the employer you are the controller of those data (see the privacy policy).
6. Your data and backups
The data are only on your phone and are not backed up automatically. Export the plan regularly as a .turni file and keep it somewhere safe. We cannot recover lost data, because we never have them.
7. Warranty
To the extent permitted by law, the app is provided as it is, without any guarantee that it will be free of errors or always available. If you are a consumer, the statutory rights granted by the law of your country that cannot be excluded by contract are not affected.
8. Liability
We are not liable for loss of data, loss of profit or the consequences of decisions taken on plans, hours or holidays that were not checked. This limitation does not apply to damage caused intentionally or through gross negligence, to death or personal injury, or wherever the law does not allow liability to be limited.
9. Updates and end of the licence
We may update the app, change or remove features, or stop distributing it. If we stop offering the subscription, renewals stop and nothing more is charged. You can stop using the app at any time: cancel the subscription in Google Play (section 3) and uninstall it. The licence ends automatically if you breach these terms.
10. Intellectual property
The app, its name and its logo belong to GiBSeS OÜ or its licensors. These terms transfer no rights other than the licence in section 2.
11. Applicable law and courts
These terms are governed by the law of Estonia, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you habitually live, and you may bring proceedings before the courts of that country. For any other dispute, Harju County Court (Harju Maakohus) in Tallinn has jurisdiction.
12. Changes to these terms
We may update these terms, for example when new features are added. The new version is published on this page with its effective date at the top and applies from that date.
13. Contact
